96 percent H-1B Visas Getting Approved As Denial Rate At Record Low!

The denial rate for the new H-1B applications has declined impressively, to as much as 4 percent. This is a huge decline as the rate was 13 percent in the fiscal year 2020.

Denial Rate of H-1B Visa Declines Significantly!

The denial rates were as high as 24 percent in fiscal 2018 and 21 percent in fiscal 2019, as per the recent findings of the National Foundation for American Policy (NFAP), a policy research organization based in Arlington.

As per Stuart Anderson, executive director, NFAP, “The 4 per cent denial rate in fiscal 2021 for new H-1B petitions was similar to the rate before Donald Trump took office, meaning the Trump years were an aberration due to imposing restrictive policies that courts found to be unlawful.”

During the fiscal year 2021, Amazon was responsible for the most approved H-1B petitions for initial employment with around 6182 approvals, followed by Infosys with 5,256 approvals. Additionally, TCS had 3,063 approvals, Wipro had 2,121 approvals, Cognizant 1,481, Google 1,453, IBM 1,402, HCL America 1,299 and Microsoft has recorded 1240 approvals.

Whereas, in 2020, the rate of denial of major IT companies like Tech Mahindra, L&T, Infosys, Cognizant was 30%, 26%, 58%, and 48% respectively.

The increase in the denial was especially noted during Donald Trump’s reign as a president in the US.

Denial Rate in 2021 Had Increased By 37%

In 2021, there were reports about the decline in the rate of approval of H-1B visa. The rate of rejection of the H-1B visas has now increased by as much as 37%!

Also changing the guidance regarding Requests for Evidence (RFEs) and Notices of Intent to Deny (NOIDs), and increasing the validity period for certain.

The H-1B cap registration has received 3.08 lakh registrations for the financial year 2022. This is a 12% increase from last year’s filing. However, the USCIS has selected 87,500 registrations only in the lotteries that meet the annual quotas.
